(6:40 PM) - Court hearings have ended for the day.
(6:34 PM) - Stern has had little reaction while Birkhead testifies. He shakes his head when Birkhead says Stern can't be the father. Finally a slight smile from Virgie when judge quips about having a tough time deciding where Anna should be buried.
(5:50 PM) - Stern shakes his head as Birkhead talks about Stern sometimes sleeping on his and Anna's couch. Stern takes notes and talks to Barth. Courtroom growing weary as judge presses on. People twisting and turning in seats. Milstein even yawns while waiting to question.
(5:49) - Stern talks to his lawyers and takes notes as Milstein questions Birkhead. Virgie watches and listens.
(5:31 PM) - Lots of theatrics from the lawyers late in the afternoon but little, reaction from Virgie or Birkhead as Stern remains on the stand.
(5:23 PM) - (note from the Web room) Judge Seidlin indicates "We're going to keep going" (into the evening).
(5:18 PM) - Texas gets tough on whether Anna's will was faxed 5 days before her death. The courtroom perks up but Virgie continues to listen without showing emotion.
(5:09 PM) -Virgie listens but shows no emotion as Texas questions Stern about the week of Anna's death.
(5:00 PM) - Virgie shakes her head as Stern states that it was normal for Anna to sound as if she were on drugs.
(4:52 PM) - Virgie not amused by all the attorney posturing. James has his hand on Virgie's shoulder as the judge questions Stern about Anna's drug use.
(4:16 PM) - Texas takes his turn at Stern on the money issue. Tunstall scribbles notes as Stern talks about his small amount of income between 2002 and 2004. Virgie showing no emotion as she listens to Stern's testimony.
(4:07 PM) - Milstein now questioning Stern about receiving money. Birkhead's lawyers doing lots of talking. Virgie taking notes.
(3:46 PM) - Virgie goes back on stand. James remains at his seat behind her counsel's table. Virgie says she received plane fare for trip to Daniel's grave. Says she did not receive any other money. Stern, hand on chin, listens. Birkhead also listens. Neither talks to his lawyer during this questioning.
(3:28 PM) - After extended morning break Virgie still not amused by judge or attorney bickering. She listens and shows no emotion as Milstein reports to court about viewing Anna's body.

(12:12 PM) - All parties enter judge's chambers without comment.
(12:04 PM) - Howard shaking his head as Virgie says her grandson did not overdose. James Arthur gets up to comfort Virgie as she breaks down in tears.
(11:52 AM) - Howard throws his arms in air as Virgie talks about "ET" exclusivity.
(11:43 AM) - Birkhead nods in agreement as Virgie clears up confusion over when she met him. Courtroom gets very quiet as Barth questions Virgie about being paid for interviews. Stern shakes his head as Virgie says that Stern has profited from Anna's death. Barth turns in disbelief as Virgie says she doesn't know how to answer question about whether or not she received money from Splash. Interestingly, I'm sitting next to a Splash reporter in the courtroom.
(11:21 AM) - James Arthur now sitting behind Virgie and to the right as she continues her emotional testimony. Stern has no reaction as Virgie points her finger at him when stating that he kept her from Anna.
(11:07 AM) - Ron Rale gets up to speak with Stern as Virgie is cross examined about estrangement. Lots of talk between Birkhead and Opri as Virgie is questioned about her first contact with Larry.
(10:58 AM) - Birkhead and Opri speak as Virgie talks about trying to visit Daniel's grave. Virgie in tears as she describes seeing Larry's flowers on the grave. A deputy hands Birkhead's sister a box of tissues. She wipes tears away as Virgie continues.
(10:50 AM) - Even Birkhead laughs at Virgie's story about working in a doughnut shop before becoming a sheriff's deputy. Stern still listening. Birkhead and Opri talking quite a bit. Dr. Perper now on phone telling court body is in good condition. Says Friday morning is fine for decision from judge.
(10:41 AM) - Birkhead writing quicky as Virgie's lawyer tries to admit letter into evidence. Stern just watches. Lots of discussion between Opri and Birkhead as Tunstall shows photo of Virgie and Anna together. The photos plus the picture of a young Daniel with Virgie cause some discussion between Stern and Krista Barth.
(10:28 AM) - Virgie Arthur on stand. Birkhead's sister, Judy, walks in as the judge begins to question Virgie about her background. Larry is seated further down his counsel's table than yesterday, about 10 feet from the railing. James Arthur is in his same spot, as is Howard Stern. He has a pen in his hand but is not making any notes. Birkhead also listens.
(10:02 AM) - Stern, Birkhead and Virgie walk into court after meeting in judges chambers. Virgie is fanning herself with a folding fan.
(8:46 AM) - The chatter in the hallway stops as Howard Stern, escorted by 2 deputies, walks into the courtroom at a leisurely pace. A minute later, Birkhead walks out and disappears down the hall.
(8:33AM EST) - Larry Birkhead and attorney Deborah Opri make an early appearance. Escorted by sheriff's deputies, they are whisked past reporters gathered in the hallway waiting for the 8th floor courtroom to open. The media and public will not be allowed in until 9 AM.
this case has turned into a circus. her mother (virgie) is so damn fake. i watch the court case everyday on headline news and that lady acts like she's crying but yet i see no tears. she acts like she does'nt understand the questions. like she's retarted. come on lady. what mother would'nt want to be buried next to her only son?.as far as virgie making money on her grandson and daughters death, YES she has, she's been on talk shows, news shows. she's a fat pig who has'nt talked to her daughter in over 10 years, but yet she knows what her daughter wants? i think NOT.bury that poor lady and let her rest in peace. NEXT TO HER SON. and deal with the other issues after that lady (ANS) is laid to rest.for virgie to have been a cop or many years. she sure is a dumb ass.
IT IS OBVIOUS THAT MONEY IS AN ISSUE ESPECIALLY FOR ANNA NICOLE'S MOTHER AND LARRY BIRKHEAD AS FOR THE BURIAL THE JUDGE NEED TO LET HER MOTHER HAVE A FUNERAL IN TEXAS AND THEN LET HER REST IN PEACE WITH HER SON DANIEL IF HER MOTHER LOVE AND CARE FOR ANNA AS SHE SAY SHE DO IT WOULD BE A NO BRAINER TO LET HER BODY GO TO THE BAHAMAS TO BE LAID TO REST.
Why is this case taking so long? Regardless of who did what to who...her son is in the bahamas and she bought a plot there and that is where she should be buried...her mother is a big fake...i cannot believe this woman!!!
All i know for sure is that Anna Nicole needs to be laid to rest next to her son whom she cherished and adored and would never want to be apart from. I also want to say that i feel so sorry for her baby daughter having to be the center of the 3 ring circus. She needs all the stability she can get and i can only imagine how her future is going to play out. She will never be left alone and it breaks the hearts of many!

Let you daughter rest in peace with her child. Don't be there now. Where were you when se was 15 did you try to get her to come home. Howard didn't keep her away. It looks like she made the choice to stay away. I worked for a drug rehab even if she did drugs why would she not let you in her home or talk to you. There is more to this story. That was slso a poor acting job in court.

Consider the money that Virgie stands to profit from if Anna's body is indeed returned to Texas for burial. I fully expect Virgie to orchestrate some type of "memorial" or "side show" of Anna's burial site, while charging admission, to the fans and curiosity seekers.
For the sake of peace,
ANS is supposed to be buried next to her dear son whom she loved dearly. Its about time people stop profiting from ANS death. Its just so unfair. She was a human being like evryone else before she died. She needs to rest in peace. Bury her next to her son and then, the so called mother can have a funeral service in Texas.
As for the liitle innocent baby girl. Whatever she inherits should be put in trust in her name and nobody should be the executor of anything. They have all made enough money on ANS. The little girl should be found a loving home that will give her the unconditional love they denied her mother.
This is so ridiculous how men go about ridiculing and becoming a public disgrace unto themselves just because of money.

maybe Virgie Arthur should have been an actress....she is so truly annoying...do the right thing for once and let your daughter be buried by her son in the Bahamas in the burial plots that Anna herself purchased...that shows all the intent that the judge needs to know - the rest is for show.
Anna's mother is a greedy cow. Shes thinking about the money not what anna would want. If they let her take anna to texas that woman while start charging admission to see the body. She make the baby leave just like anna did when she was old enough.
From Virgie holding court(no pun intended), to her professional makeup job, to her citing chapter and verse about her life and that of ANS, then suddenly she can't answer simple questions asked and re-asked. A deer in the headlights absolutely. And then the convenient tears, including the need for a recess, as a diversion to having to answer.It was quite apparent she did accept money off her daughter's misery. I don't undestand this judge leading the witnesses. Nor do I understand why Virgie is allowed to make damning statements ad nauseum about Stern with no one stopping her.Why is Stern's testimony stricken because it's heresay, yet Virgie's is allowed as fact? Not much makes sense here.She contradicted herself so many times, even about her association with Birkhead, and Stern's lawyer wasn't allowed to call her on that either. And Tony Potts is like a drooling bulldog re: Stern; quick to plant suspicions where no law enforcement agency has, giving a supposed timeline without all the facts/statements by witnesses and, generally saying inflammatory things. It's pretty outrageous.Hopefully, this portion will be over swiftly and Ms. Smith can be put in her proper resting place-with her son.
This whole thing is ridiculous. Virgie should surely understand that any mother would want to be buried next to their child. It should not be a question. Virgie should be allowed to attend the funeral. They need to lay Anna her to rest and move on to the bigger question, "who is the father of the girl"? Anna has already passed, lets focus on what is important.
I just want to say since I have a daughter (also 39) in almost the same situation. As a teen she got with the wrong crowd and became very beligerent toward me. She told her friends that I beat her (untrue) and that she hated me. She ended up marrying an x con who is back in prison again. Everytime she needs something like money(which I don.t have.) She would still call me up until about 4 tears ago when she became angry with me because I tried to get her off drugs. I haven't heard from her If She died today I would still love her and she me. This is why I can understand Virgies wanting her daughter.

As Virgie continues to spew garbage, her daughter's body is deteriorating in a cold, damp, medical examiner's building. Virgie should be ashamed of herself. She was a disgrace to her in life and now she is a disgrace to Anna in death. That poor woman, let her go be buried with her son. Show that you can be the compassionate mother you claim to be.
The only reason that ANS's mother is crying is because she knows she's a greedy liar and I hope that Stern proves it. Any mother in her right mind make sure that her daughter was buried where she wanted to be. Not this idiot! Not only does she want to take ANS back to Texas, she wants to dig Daniel up and take him with her too! What a jerk!
She needs to stop dumping all of these accusations on H.K. Stern. I don't hear her saying anything about what a piss poor mother she was. Perhaps she should add that to her testimony. At least we know that that is true. Anyone who ever watched the Anna Nicole Show knows that Anna was the one in control. She was always "bossing" Howard around. He loved her. No doubt about it.
This court case is being held for only one reason. Who should be able to bury Anna Nicole. The judge is acting like the judge in the OJ Simpson case. He wants to be of TV. He is NOT there to look after the baby. That is for the courts in Califorina. This is a probate case only! How is the baby going to benefit where her mother is buried. The judge is showcasing himself! If Virgie had ANY relationship with her grandson or her daughter in the last 10 years that would have come out. Her grandson had free will. He could have visited his grandmother!! But he did not. And Virgie did not seek them out! This judge should be removed. He wants his own TV show. This Virgie person is a fraud and no mother would go on TV BEFORE the death of her daughter accusing her own daughter and/or her fiance of killing her grandson. Now Anna Nicole is dead and she says she loves her! She went of TV accusing her of murder along with Howard! Why is all of this being allowed! Howard Stern stood by Anna Nicole for 15 years. The only one who did that was him! Berkhead's lawyer has such a evil snear to her mouth. It's awful to look at her when she talks.
I think that Howard should get the body to put Anna to rest next to her son. Her mother is all show and really got involved for money only. Why would Howard need the money when he is a lawyer who makes good money? You can see it on his face the love he had for Anna and her children and how he would give anything to have them back. Anna's mom is a joke and if she gets her way she will be set for life because of her daughter and grandson's death. I hope and pray that Howard gets the body and is the babies father. I also hope that he keeps Anna's life alive through her daughter.
Everyone has no problem cutting down Virgie and I agree but I dont think Howard K. Stern is any better. All I want to know is how come two people in great health being taken care by the same person just all of a sudden die six months apart. Dosen't that seem to be to much of a coincidence, come on. Not to mention when Daniel died, Anna Nicole was so out of it when Dannylyn was born Howard could of made anything happen!

Vergie is Vicky Lynns' mother. The judge should allow her mother to decide what should be done with her daughter and grandson. There is no way in hell that Sterns' mother would allow ANY friends of his (regardless of how well they "know" him) to decide where Howard is to be buried.
This is a mess because Stern has been calculating and manipulative since the Marshall case, which by the way hasn't closed, and for which he (personally/legally) would be paid 6 million dollars. Holy cow, this is a BIG mess.
Vergie should go back under the rock where she came from. The body should be with her son. Anyway to me this is just a lot of lawyers sucking the money from the clients. DNA testing should have been done a long time ago. Lets get this mess over with.
I can't help but to feel disgusted on how this whole mess is being handled by the judge, the mother, the lawyer and the wanna be daddy. It seems what's most important is lost...Danielynn's future and where should Anna be buried. I'm a mother. If I were to lose a child by death, I would find peace knowing in the future I'll be buried next to my child. Please people...Anna has a voice even in death...she wants to be close to the only love of her life...her son. She loved her daughter, but time didn't allow her to grow more in love w' Dannielynn. So the love of her life is in the Bahamas and that's where she should be buried too. Her mother is a pathetic human being. After adding insult to injury by badmouthing Anna shortly after Daniel's death. Anna was grieving at the time and this is the support she got from her mom? Virgie how dare you want to call the shots now? Oh I forgot....there's money involved.
I feel sorry for the baby[Dannylyn], she will grow into a wonderful lady not knowing her. As regards to Ms Arthur, I can't undestand why she is fighting for Ms Smith's body. What happened to respect and honor her wishes, she made it clear on national tv how much she hated her mother. So please let her rest by her son.
For all those who think Vergie is a saint they are crazy. If this woman was such a good mother where was she all these years. I no more believe she had a relationship with her daughter anymore than I believe she did with her grandson. I am with the other person if her grandson wanted to see her why didn't he? He was a grown man and legal age to do what he wanted. Wouldn't it all be great if those of us who have options were right about what we think. I don't know what went on with Daniel when he died anymore than any of you. I also don't know what Anna did in her life and what happened as well. However if there was fowl play in the deaths it will come out and someone will pay but until that is done we have to go with what we know not what we think. So if you know for sure that Howard killed these people maybe you need to be in court to support it and to tell everyone why. Just like I could think her mother killed them we all have thoughts. I just think that someone who has stuck with some like Howard has would have a hard time showing the emotions he is if he had anything to do with it. Look at her mother she wipes her eyes but no tears, she is on the news but not for her daughter. I am sorry I just don't buy it she is getting paid and I think Anna needs to be where she wanted next to Daniel in the Bahama's. The biggest thing that needs to be done now if to find out who the real father is so that this baby can have some sort of normal life and not a circus.
I'm sure Virgie made mistakes as a mother, as most mothers do. At least she did try to warn ANS that she may be next if she wasn't careful. I think Virgie knows a lot more about her daughters life than any of us do. She knew ANS life was in danger, but ANS chose not to listen. I also know what it's like to have a family member turn to drugs and completely turn on their family. They hang with the people they have become, and their whole life becomes one big lie. The people that love them and want them to change are the enemies. I was spanked or whipped as a child with whatever my parents could find to do it with, but I have never blammed my parents for the mistakes I have made as an adult. I believe Howard Stern is not innocent in this whole mess. I think he enabled ANS to continue down her distructive path, and chose not to do anything about it. It's all about choices, ANS chose to live the life and lies she was living, and HKS chose to let her. Yeah, that's true love for ya!
This is all insane. Bury Anna by her son. Give the baby to its biological father. Put Anna's money in a trust fund for the baby ONLY. Set it up to where noone can touch it but only Danielynn when she turns 21..and be done with this mess.
I think in one way or another all the parties involved. Are getting paid for there input on Anna Nicole. The way they saw her in their eye's. Either way the woman is dead and now the most inporant person right now is to bury her and take good care of the little girl. No matter what that little girl will find out the bad and the ugly about her mom. And what she did.
I hope Stern gets this whole thing done for Anna. I believed he is the one who truly cared for her and is trying to make it his point to get her buried with her son and take care of the baby. Her mother may still care about her but she only wants the lime light as seen by her getting paid by all these reporters for all kinds of things and she only wants custody of Dannielynn so she can get that money from Anna's court trial from Howard Marshall. She is greedy and Larry Birkhead needs to hurry up and get out of the picture too. I hope Howard turns out to be the father and gets to lay Anna near her son like she would have obvioulsly wanted to. Howard has all my backing.
I have been watching the trial of Anna Nicole religiously & are disgusted how selfish people become after one dies. Anna's Mom is playing the victim while she is on the stand. She is a liar & it clearly shows! To play dumb to some of the questions Counsel was asking her in regard to receiving money from tv appearances is bull!! The only time she shed a tear on the stand was when she felt she was being attacked with questions. I am on Howard's side. He is really getting the bum rap here. The whole situation is very unfortunate.
through thick and blood virgie knows best about the danger what her daughter anna's facing in the hands of Howard Stern. i agree with her w/o a lies saying it in court. and i do believe that Larry Birkhead is the biological father of danielynn. there was a resemblance in between Larry and to the baby danielynn face and thats the real proof of it.
I don't understand what is so hard for the judge. Virgie & Anna were estranged. Anna did NOT want anything to do with Virgie. Anna was NOT living in Texas. Howard was THE constant in Anna's life. Anna WANTED Howard to be the guardian of her beloved son. That one point alone speaks volume to a mom! Anna WANTED to be buried next to her beloved son and even bought the plots so that she could be buried next to him. I think EVERYONE should know that Daniel was #1 in Anna's life with Howard right behind.
It would be nice if the judge could make all involved in the case submit to lie detectors. To me, HKS seems the most sincere when it comes to Anna and her wishes.

The Judge is joke. Virgie is a lying jerk. Burkhead does seem like a nice guy and I was impressed with him. The judge treats Virgie and Burkhead with respect but not Howard. Mr. Stern is the only person who loved and cared for Anna. The pain he feels shows in everything he says and does. Anna wanted to be with Stern, she trusted him and it seems that he never failed her. I fear that Howard does not stand a chance with this judge and I don't understand the attraction and respect that he shows to Virgie when most of us can see what a fake she really is. I am behind Howard K. Stern 100%.
Ok, it has been one LONG week. I think I have a way to resolve the matter. Why doesn't the court allow Anna to be burried next to her mother and her brother in the Bahamas, until Dannilynne turns 18 or 21???
In the current courtroom, grant Dannilynn the power to keep the bodies status quo once she turns of age, or move them if she so desires. The location where she might move them, of course would be of her choice and in their best interest.

Then a court needs to appoint an independent trustee, to watch over any possible money the baby might now or in the future, be entitled to receive.

Lastly...file a restraining order against Virgie, so that she may NEVER tamper with little Dannilynne and her future life.

I'm getting fed up with all of them. The judge is a cartoon character. Howard Stern is a dirt bag. He hasn't worked for 5 years and he's had no problem living off his parents and Anna Nicole. As for Virgie Arthur, she perjured herself on the stand and was forced to admit she was compensated. She must have been the dumbest cop on the Houston force since she can't understand the simplest questions put to her. Regardless, I hope the looney judge lets the poor girl be buried with her son and orders the paternity testing. All you have to do is look at Stern and that cute baby to know there is no way he is the father.
I totally agree with everything that everyone is saying. I ma afraid that Daniel's real father might be able to exhume his body and be able to move it to Texas.This is all so sad. They do not talk about what they should. They should go ahead and bury her anyways the way that she wished. If anyone noticed,in the interview that Anna had that she was so mad in about her mother, her eyes were very bright and clear to me. Her mom keeps saying, well she was on drugs all the time that the decisions were made. Did anyone notice that her mom started to act a lil drugged herself after she got caught in here money lies. Ha! I loved it. Also..if she was a cop before for 18 years, how come she can't keep her composure. She was literally shaking.Trying to make excuses in her time outs and whining.I just wish that Howard could do as Anna wanted and have Dannielynn. There are a lot of stories that aren't making sense. First of all - I wouldn't have that baby anywhere near Howard Stern. It's just a little too suspicious that he was there when Daniel and ANS died. Is the guy daft?? He keeps insisting that he's the father when there's an army of men who have come forward to claim they could be the father. There is nothing genuine or sincere about this man. And - all the stories are inconsistent at that. The bodyguard/nurse claims his wife called him to say something was wrong and to get back to the hotel asap. He states that his wife called him 2 minutes before to say everything was ok. How can that be? Then his wife tells him to call 911 because she can't get to the phone. Well you're on the phone with your husband - how can you not get to the phone? IF you're a nurse - wouldn't it make sense to call 911 first and not your husband? Then Moe hangs up with his wife and calls Howard and not 911 first. Are these people for real. Moe's wife said she was giving ANS CPR. Then MOE says when he got to the room - his wife was on Anna giving her CPR - so - he pulled the sheets down and saw that her lips were blue. If his wife was giving her CPR - how did she do this with the sheets over her face? The wife claims she didn't call 911 first because she had to keep ANS's airway open. Any qualified medical professional (or layperson) knows you get help first and then do what you can.
There is something seriously wrong with the stories Howard, Moe and his wife are giving - something is not jiving.
Finally!!!! Anna may you and your son rest in peace now!!reunite and be happy
